Res Subjudice

The rule of Res Judicata is applicable when the matter is already adjudicated upon by the Court.


In case of Res Subjudice, It relates to a matter, which is pending in the Court of Law.

2.

The Res-Judicata prevents the trial of a suit or issue in which the matter in issue has already been decided in a previous suit.


It bars trial of a suit in which the matter is pending for decision in the previous suit.
